The Supreme Court, on Thursday, declined to stay the trial against the two Italian marines under the charge of murder of two Indian fishermen off Kerala Coast in February and it also issued notices both to the Centre and the State Government on their plea for quashing the trial against them. Based on the recent Government’s clarification on the extent of Indian territorial waters, senior advocate Harish Salve pointed out that the case of the Enrica Lexie falls outside the jurisdiction of Indian authorities. The bench consisting of Justices Altamas Kabir and J.Chelameswar took into consideration the similar plea by the Italian Government and the two accused marines who are on bail now, and fixed a hearing on Aug. 8. Moreover, Italy had clearly stated that the two marines acted in the interest of the vessel’s safety, only after a pirate alert. Italy had also said: “If the incident happened because of the action of someone on official duty, Republic of Italy takes full responsibility”.
