HBT can remove equipment from Haldia but not to re-deploy it outside India, Court

A division bench of Calcutta High Court allowed ABG-LDA managed Haldia Bulk Terminals (HBT) to remove its equipment from the Haldia complex but it restrained it from using it outside India. HBT, however, could use its equipment on intimation to the Court appointed officers and the port authorities. To cut short the history of the strained relationship between HBT and Kolkata Port Trust, HBT withdrew its operations from its two mechanized berths 2 and 8 in the middle of the ten-year contract citing law and order problem at the port. Left with no option, the Trust sought the intervention of the court not to permit HBT to remove its equipment from the dock complex. The single bench of Justice Sanjib Banerjee tuned down the request of the Port Trust which, in turn, challenged the decision in the division bench. The division bench of Justice Asim Banerjee and Shukla Kabir (Sinha) on Wednesday directed that the assets of HBT could not be alienated and could be used upon intimation to the Court-appointed special officers. This information is given by the Port Trust’s advocate, Mr. Ashok Kumar Jena. He also added that the trial court processing would continue.

A broken relationship can be soldered at best but cannot be restored.
